The Bureau of Administrative Review will issue a temporary driving permit to a person challenging a license suspension as a result of a DUI arrest. The temporary permit is valid for approximately 42 days, providing the driver with limited driving privileges as he or she awaits the review hearing. The temporary permit is not a picture identification card. Rather it is a single piece of paper that contains critical information about the driver. It is important for the driver to keep this permit available at all times when driving a vehicle. If the driver fails to show the permit, he or she could be arrested and serve time in jail.
The temporary permit is a restricted license, permitting driving for business purposes only. Business purposes are defined by Florida law as driving necessary to maintain one’s livelihood. These purposes include driving for work, medical needs, religion and education only. A person driving for purposes beyond the restricted needs outlined in the law could face additional criminal charges.
The temporary permit is a paper license and does not constitute valid government identification. A person arrested for a DUI in Florida challenging a license suspension must use another form of government identification, such as a passport, if needed. A Florida ID card will not be issued by the Department of Highway Safety and Motor Vehicles while a license suspension is being challenged. If the arrestee obtains a Florida ID card, the Bureau of Administrative Review will not issue the temporary driving permit.
