CTC12-0628WJZTWS – Pasco County – November 2012 (DUI Case)
Defendant was arrested for DUI because he had an inoperative taillight. Upon contact with the officer, Pasco deputies indicated they smelled alcohol, that defendant’s speech was slurred and his eyes were bloodshot. Officers claimed he failed field sobriety exercises and arrested him for DUI. He provided breath samples of .034 and .031. His urine tested negative for any controlled substances. Arguing that the state had zero evidence of impairment, Stephen Higgins got all charges dismissed.
