The defendant was pulled over on Siesta Key in Sarasota County for an improper passing by a deputy of the Sarasota County Sheriff’s Office. This deputy noticed the odor of alcohol and called out a DUI unit to perform a DUI investigation. At that point, the defendant was made to perform field sobriety tests and was arrested for DUI. She was taken back to the Sarasota County Jail where she blew a .14 on the breath test. Darren Finebloom filed a motion to suppress all evidence obtained in this matter because the detention of the defendant was unlawful. Darren Finebloom argued to the court that the odor of alcohol and the improper passing was insufficient to detain the defendant for a DUI investigation. The court agreed and the State Attorney’s office dismissed all charges.
