Charge: Leaving the Scene of an Accident
Result: All Charges Dismissed
There was an accident in which one vehicle struck another vehicle in a private gated community. The police were called out. A description of the vehicle was given to the police and an investigation ensued which resulted in the defendant being charged with leaving the scene of an accident. Darren Finebloom filed a motion to dismiss based on the law which says, “One cannot be arrested for a criminal traffic violation in a private gated community”. The motion was heard. The judge in the case agreed with Mr. Finebloom and dismissed all charges against the defendant.
